  DEFENSE DEPARTMENT SWITCHES SIDES, WON'T CHALLENGE 8-VSB

  According to Broadcasting & Cable ("B&C") magazine,
1/24/00, p. 27, the U.S. Defense Department, after meeting with
broadcasters and consumer electronics makers on Jan. 13, says
it will NOT challenge the 8-VSB DTV modulation standard after all.
Now, FCC Chairman Kennard is urging his four fellow commissioners
to dismiss Sinclair's request to add COFDM as an option for
broadcasters (B&C, 1/31/00, p.65).  If an agreement to dismiss
does not come shortly, Kennard may schedule a vote for the
Commission's February 17 meeting.

  FORFEITURE WATCH (SELECTED ITEM)

  $7,000 - To Queen of Peace Radio, WQOP, for failing to
maintain a meaningful staff presence at their main studio.
The FCC wrote: "Although the station's general manager reported
to work at the main studio, spent a substantial amount of time
there, and used the studio as his "home base," no other staff
had regular hours at the station.  Consequently, it appeared that
there were no licensee personnel at the station's main studio
during certain business hours."

  ISRAELI PIRATE BROADCASTER JAILED

  From the international wire comes word that an alleged
Israeli pirate broadcaster has been told he will find out what
the inside of a jail cell looks like.  Judge Shmuel Barukh issued
a sentence of 8 months imprisonment, 26 months suspended sentence
and a 200,000 sheqel fine on Shalom Nahmani who was convicted of
operating pirate radio station "Radio Centre" for a period of a
year and ten months.

  We here at the FCC STILL get panicked inquiries on that
long-dead (25 years!) rulemaking petition.  So many that I posted
the pertinent portions of the decision on the ASD's Web site at:

  That way, people can read it for themselves.

  This page takes a steady 150+ hits a month, which is astounding
for a 25-year-old decision.

  ORDER ON RECONSIDERATION OF 99-393:
  FCC ELECTS TO BYPASS A SENSITIVE RELIGIOUS ISSUE

  While RM-2493 departed the scene long ago, Jon Foreman of
KSGN(FM) reminds us of a very recent attempt by the Commission
to inject itself into religious programming when carried by non-
commercial/educational stations.  The FCC essentially argued
that more than half of a non-commercial religious broadcaster's
programming must 'teach' rather than 'proselytize.'  That opinion
drew such a hail of criticism that the Commission reversed itself
a few days ago, putting the lid back on Pandora's Box.  Read
