  FCC RETAINS BIOLOGICAL CONSULTANT
  The Commission has retained Avatar Environmental
Services of West Chester, Pennsylvania, as a biological
consultant to assist in fulfilling the FCC's role under the
National Environmental Policy Act (NEPA) and other federal
environmental statutes.
  Avatar will give the Commission access to the services of
experts with training and experience in evaluating the impact
of construction projects on animal and plant species.  They
have performed similar services for other agencies.  The
possible impact of communications towers on migratory birds
is one of the immediate pressing issues.

  NAB OPPOSES LOCAL CONTENT CARRIED BY XM & SIRIUS SATELLITE
  Following is the FCC's summary of NAB's April 14, 2004
Petition for Declaratory Ruling to prohibit satellite radio
broadcasters XM and Sirius from providing locally-oriented
programming on their nationally distributed channels.  (The
logical counter argument, of course, is that ground-based radio
stations should be prohibited from broadcasting anything but
locally-produced programming.  Now that would be interesting
to hear.)

  FCC FORFEITURE WATCH: CLEAR CHANNEL TOWER PAINTING VIOLATION
  In 2002, the Commission issued a $10,000 Forfeiture Order
to Clear Channel Communications ("CC") for faded and chipped
paint at WOUR(FM), Utica, New York.  CC argued that the "routine,"
"drive-by" inspection "should not have taken place," given that
CC had used the Alternative Broadcast Inspection Program run by
the local broadcasters association, giving WOUR three-year
immunity from routine inspections.
  The FCC countered that this was not a "routine" inspection
as CC had claimed.  Rather, the drive-by inspection was part of
the Commission's field-wide targeted tower safety program.  The
$10,000 fine stands.

  FCC FORFEITURE WATCH: FINES AFFIRMED AGAINST TWO ALLEGED PIRATES
  Fines of $10,000 each have been affirmed against Jason Green
and Gary Feldman, alleged pirate broadcasters in Florida.  Both
individuals had reportedly operated on 91.9 MHz, and both failed
to file responses to the Commission's initial findings.

  FCC ENFORCEMENT BUREAU NAMES REGIONAL COUNSEL
  The FCC has announced the appointment of Margaret Egler
as Regional Counsel for the Enforcement Bureau's Western Region.
The Western Region is comprised of District Offices in Los
Angeles, San Diego, San Francisco, Denver and Seattle, and
Resident Agency Offices in Honolulu, Anchorage and Portland.
  Regional Counsel is a newly created position that will
provide legal advice to Enforcement Bureau field staff and
coordinate field enforcement matters with the Commission's General
Counsel's Office, the Department of Justice and the other
Divisions within the Enforcement Bureau.
  Margaret Egler has held several FCC positions including
posts in the Cable Services Bureau and the Mass Media Bureau.

  SAN DIEGO'S 96.9 MHZ PIRATE REACTIVATES
  According to a news bulletin from Chris Carmichael, San
Diego's 96.9 MHz pirate is back on the air.  The signal might
even be improved by this weekend.  No news on the location of
the transmitter site, but that will only take the Commission
a few minutes to figure out.  Collecting solid evidence of
wrongdoing on a number of occasions, and giving the pirate
"due process" rights, are the time-consuming parts.

  PIRATE WATCH, LANCASTER
  Following are extracts from a letter sent April 30 to the
Los Angeles FCC field office, and copied to CGC:
  "I'm writing you to report a pirate radio operation which
is interfering with listener reception of KCRY, Mojave 88.1 FM.
  "The station is operating in Lancaster at 87.9 FM from the
location of [a specific record store in the vicinity of the LA
County Sheriff's station]....  We estimate the output power of
this transmitter [to be] approximately 50 watts."

  AM & FM PIRATE IN VICTORVILLE DEFIES FCC PRESSURE
  That pirate in Victorville is still operating full time on
AM 660 and FM 91.3 in defiance of FCC actions to shut it down.

  LOOKING TO ARGENTINA FOR INFO ON XEKTT, XESS & XESDD
  One CGC Communicator reader discovered an article of
interest in Argentina's "DeRadios" newsletter which sometimes
carries items of interest to the Spanish speaking community of
North America.  Such was the case about a week ago when the final
story posted at <http://www.deradios.com/info.htm> read as
follows (rough translation provided by the reader):
  "The Mexican authorities (SCT) have announced a solution to
the demands of the government of the US regarding the alleged
interference caused by three Mexican radio transmitters to
[stations] in California.  But the interference caused to
Mexican stations by 473 US transmitters and the (continuing)
violations by the US government of the bilateral agreements
was not resolved.  (Or, was left without solution.)"
  Remember, this is a foreign report, a Latin perspective
and a rough translation.
