  FRAUDULENT 301 APPLICATIONS FILED WITH FCC
  A number of fraudulent FCC Form 301 applications have been
filed with the Commission this month.  The FCC has even Accepted
for Filing a number of these fake applications, and has assigned
them file numbers.  One application for a conventional (non-
grandfathered) Class B FM station calls for 105 kW ERP in a
Class B zone where only 50 kW is allowed without a waiver request
- and there was no waiver request.  It is as if the Commission is
not screening incoming applications for even blatant defects.
  In the LOCAL ITEMS FROM THE FCC section of this newsletter,
CGC has determined that the Applications Accepted for Filing
for KLVE(FM), KPWR(FM) and KWVE(FM) are all fakes.  The engineers
named in these applications have confirmed to us that they played
no part in the preparation process.  A number of other Accepted
applications in the LOCAL ITEMS FROM THE FCC section below are
suspect - TV included - and are marked as such.
  We urge you to check the LOCAL ITEMS FROM THE FCC section of
this newsletter and investigate any Accepted applications bearing
your station's call letters.  One fake application proposed to
move a transmitter miles from its authorized site, while in other
instances the proposed changes were far more subtle.  You can view

  The hallmark of the forged applications is that they seek fee
exempt status (meaning in part that there will be no money trail
for the Commission to follow), where fees would ordinarily be
required.  The bogus filings obviously took a good deal of time to
construct, so this is no mere prank.  Apparently a series of bogus
filing accounts were set up with the FCC to allow these illegal
filings to take place.
  Twenty years ago, FCC engineers reviewed each and every
incoming application.  Today - as these forged applications so
aptly demonstrate - the Commission will stamp almost anything
"ACCEPTED FOR FILING."  With several confirmed and suspected
fraudulent applications in our part of southern California, how
many more could there be nationwide?
  The purpose of the forged applications is unclear, but
coming so close to the elections one must wonder if the action
is intended to underscore the extreme fragility and vulnerability
of our electronic voting system.  Overall, punched cards worked
fine.  And we didn't need computers to build Hoover Dam.  The
government assures us that it is protecting us in the voting
process, but the FCC - an expert agency in matters electronic -
can't even guard its own front door.

  FCC FORFEITURE WATCH - XEMO(AM) BUSTED FOR OVERPOWER OPERATION
  XEMO, 860 kHz, Tijuana, is the latest station to be busted
by the FCC for a) overpower operation, b) transmitting from a
site not approved by U.S., and c) causing substantial interference
to a U.S. station - KRLA, Los Angeles, in this case.  The details
are fascinating to read (see the URL below), and the fine for XEMO
is $25,000.
  The FCC has leverage in this case because XEMO relied on
FCC-issued Section 325(c) cross-border program transmission
authority to broadcast Padres Baseball.  One of the conditions
of that authority is that XEMO operate "in full compliance with
applicable treaties and related provisions concerning electrical
interference to U.S. Broadcast stations" - a condition that was
violated in this case.

  In other news, an AM station in the Denver area has been
fined $8,000 for operating an aural STL transmitter on the wrong
frequency and at an unauthorized site.

  SCFCC MT. WILSON PICNIC SCHEDULED FOR NOVEMBER 10
  Due to fire restrictions being lifted by the USDA Forest
Service, the SCFCC has rescheduled its annual business meeting
and Christmas Party Picnic for Wednesday, November 10 at 10 a.m.
at the usual location (the Mt. Wilson auditorium near the
Pavilion).  The event is open to all southern California broadcast
engineers, and includes a free barbecue lunch.

  THE KXO TOWER COLLAPSES IN EL CENTRO
  The KXO AM&FM tower in El Centro, CA collapsed on Saturday,
October 16, 2004, during a period of high winds.  According to
Carroll Buckley at KXO, vandalism is not suspected and the true
cause of the disaster is under investigation.  (A broadcast
engineer who has seen the fallen tower reports that the collapse
was due to a failed guy wire anchor bar eaten out by underground
rust - but this information has NOT been confirmed by station
executives.)
  KXO has been on the air with this tower - their one and only
tower - since 1976.  The tower was reportedly last inspected only
a year ago, and the station anticipates that 6-12 months will be
needed to erect and equip a new tower.
  Now for the good news.  Support from local area stations was
almost overwhelming right after the collapse, and KXO(AM) has
already returned to air using two 90' power poles to support a
temporary wire antenna.  Coverage is "surprising good" according
to Carroll Buckley.  KXO-FM was expected to return to the air
late last week using a third 90' power pole for its temporary
antenna support structure.

  TOSHIBA TV SENDS DISTRESS SIGNAL ON 121.5 MHZ
  On October 2, a 20 year-old college student in Corvallis,
Oregon was visited at his apartment by a contingent of local
police, civil air patrol and search and rescue personnel.  Seems
that the student's year-old Toshiba flat-screen TV was emitting
an international distress signal picked up by satellite on
121.5 MHz.  "They'd never seen [a] signal come that strong from a
home appliance," the student said.  "They were quite surprised.
I think we all were."   Considering some of the material being
broadcast today, can anyone blame a TV for calling for help?

  in the FCC's daily Applications sheets.  Nevertheless, we see
  that these apps are in fact Accepted according to the FCC's

  other suspected fake applications for Sacramento, CA.
