  GOLDFIELD PIRATE FACES LEGAL OPPOSITION
  The Special Temporary Authorization (STA) issued under
the urging of Senator Harry Reid to the Goldfield, NV pirate
- allowing the pirate to legally return to the air - is being
challenged by the law firm of Leventhal, Senter & Lerman (LSL).
  In its February 28, 2007 Petition for Reconsideration, LSL
asks that the STA be "reconsidered and reversed" because of
FCC Rule 73.854 - precisely the rule cited by one of our readers
in CGC #785.  The Petition is easy to read and is available at
the URL below (1.4 MB).
  Hopefully major broadcast publications will pick up this
story and help the Petition gain traction.  It's not that
Goldfield is undeserving of an LPFM; it's that the person
granted authority to operate the station is apparently
prohibited from doing so by law.

  TWO DTV TUNER WAIVERS SOUGHT
  Two requests have been filed with the FCC for limited
exemptions to the DTV tuner requirement now in place.  One request
has to do with "televisions designed for hotels to use with their
closed circuit video systems" while the other involves "bathroom
mirrors with an optional television receiver integrated behind the
mirror."  The FCC is treating these as "permit-but-disclose" cases
meaning that a decision will not be forthcoming soon.

  WIRELESS BROADBAND INTERNET ACCESS SERVICE CLASSIFIED
  AS AN "INFORMATION SERVICE"
  By classifying wireless broadband Internet access service
as an "information service," the FCC says it has ensured that
this service will be free from unnecessary regulatory burdens
and provide consumers with more and better services at lower
prices.

  LAND-MOBILE 6.25 KHZ NARROWBANDING
  Regarding the FCC's push toward 6.25 kHz narrowbanding in
the 150-174 & 421-512 MHz private land-mobile radio bands, the
FCC has adopted an Order that declines to establish a fixed date
for the transition.  Nevertheless, the Commission strongly urges
licensees to consider migrating directly to 6.25 kHz technology
rather than first adopting 12.5 kHz technology.

  o  Charles E. Vance, III (d/b/a CB Candy Electronics) has
been fined $14,000 for offering for sale non-certified Citizens
Band ("CB") transceivers and external RF power amplifiers.
  o  Santa Monica Place shopping mall fined $3,200 for
operating a radio repeater on the wrong frequency and causing
interference.
  o  Manufacturer of powerful CB transmitters gets an upward

  o  Amaturo Group of L.A. was tentatively fined $7,000
for "failing to maintain a local main studio" for KLIT(FM) in
Fountain Valley (CGC #741).  Now, that fine has been canceled
after the FCC considered Amaturo's response.

  IN SUPPORT OF LPFMs - RIGHT NOW - IN VERY RURAL AREAS
  I am a (very) part-time resident of Goldfield, Nevada - the
town where the current uproar about Senator Harry Reid's personal
involvement in an STA is taking place - and his involvement was
heavy-handed for sure.  Let me say this: Goldfield is a poster
child for a place that needs SOMETHING on the radio dial....
There should be a way - not in the future, but now - for LPFM
licenses to be granted in very rural areas.
